The Full Federal Court recently handed down its decision in Facton Ltd v Rifai Fashions Pty Ltd. The case involved the importation into Australia of infringing branded clothing.
The judgment includes a useful discussion of additional damages under section 115 of the Copyright Act 1968 and damages for passing off.
