On 9 December 2011, IP Australia released a consultation paper in relation to its fee review. While still a proposal, the trade mark fees are expected to increase in two stages.
Most of the fees should be increased from 1 July 2012 and the fees in relation to new online or B2B services (e.g., Headstart applications and electronic applications) would increase from 1 October 2012. Some of these newly proposed fees are below:
While an increase in fees, when they are split into stages, may not seem substantive, the overall price of one trade mark in one class, if filing electronically, would increase from $370 to $420. This reflects a 13.5% increase.
Anyone seeking to register a trade mark, should, therefore, rush to lodge their application before 1 July 2012.
