Roadshow goes to Canberra

Roadshow Films has been granted special leave by the High Court to appeal against the decision of the Full Federal Court that iiNet did not “authorize” infringement of copyright in movies that its customers shared using BitTorrent file-sharing software.

(Under the Copyright Act, people and organisations may themselves infringe copyright if they “sanction, approve or countenance” someone else’s infringement.)

Justice Crennan indicated that in her view the case raised matters both of important legal principle and public policy.

The appeal before the High Court is likely to take 2 days of court time, but no date has yet been fixed.
